Accommodation Terms and Conditions<\/h1><\/div>

1. Scope of Application<\/p>\n

The accommodation contract and related contracts entered into between the Hotel and the guest shall be governed by these Terms and Conditions; matters not provided for in these Terms shall be governed by laws and regulations or generally established customs.<\/p>\n

When the Hotel has agreed to a special arrangement to the extent that it does not violate laws, regulations, or customs, notwithstanding the provisions of the preceding paragraph,<\/p>\n

such special arrangement shall prevail.<\/p>\n

\u00a0<\/p>\n

2. Application for an Accommodation Contract<\/p>\n

A person who intends to apply for an accommodation contract with the Hotel shall notify the Hotel of the following matters.<\/p>\n

    \n
  • Guest’s name, gender, and number of guests<\/li>\n
  • Date of stay and estimated time of arrival<\/li>\n
  • Accommodation charges (in principle, in accordance with Appended Table 1)<\/li>\n
  • Other matters deemed necessary by the Hotel<\/li>\n<\/ul>\n

    If, during the stay, a guest requests to continue the stay beyond the date of stay in item \u2461 of the preceding paragraph, the Hotel shall treat this as a new application for an accommodation contract made at the time such request is made.<\/p>\n

    When the Hotel requests submission of a guest register stating the guest’s name, address, telephone number, and other details, the applicant shall submit it immediately, even after the accommodation contract has been concluded.<\/p>\n

    \u00a0<\/p>\n

    3. Conclusion of the Accommodation Contract, etc.<\/p>\n

    The accommodation contract shall be deemed concluded when the Hotel accepts the application referred to in the preceding article. However, this shall not apply where the Hotel proves that it did not accept the application.<\/p>\n

    When an accommodation contract has been concluded pursuant to the preceding paragraph, the applicant shall pay, by the date designated by the Hotel, an application deposit determined by the Hotel, up to an amount equivalent to the accommodation charges for the period of stay (or for three days if the period exceeds three days). If payment is not made by the date designated by the Hotel, the accommodation contract shall lose its effect. However, this applies only where the Hotel, in designating the due date for payment of the application deposit, has so notified the guest.<\/p>\n

    The application deposit shall first be applied to the accommodation charges ultimately payable by the guest; where circumstances arise to which the provisions of Articles 6 and 17 apply, it shall be applied first to cancellation charges and then to compensation, and any balance shall be refunded at the time of payment of the charges under the provisions of Article 12.<\/p>\n

    Even where the Hotel has presented or provided an incorrect accommodation charge via its website, by telephone, or otherwise, and an application for and acceptance of an accommodation contract have been made based on such charge, if such charge was markedly lower than that for the dates before and after it, then, unless there is an indication of the reason for such markedly low charge (such as \u300climited\u300d or \u300cspecial\u300d), the acceptance shall constitute one made under mistake under the Civil Code, the accommodation contract shall be rendered void, and the Hotel shall promptly give notice to that effect.<\/p>\n

    \u00a0<\/p>\n

    4. Special Arrangement Waiving Payment of the Application Deposit<\/p>\n

    Notwithstanding the provisions of the preceding article, the Hotel may agree to a special arrangement whereby payment of the application deposit referred to in that article is not required after the conclusion of the contract.<\/p>\n

    Where, in accepting an application for an accommodation contract, the Hotel does not request payment of the application deposit referred to in the preceding article, or does not designate a due date for payment of such deposit, it shall be treated as having agreed to the special arrangement referred to in the preceding paragraph.<\/p>\n

    \u00a0<\/p>\n

    5. Refusal to Conclude an Accommodation Contract<\/p>\n

    The Hotel may refuse to conclude an accommodation contract and to permit the use of the various facilities within the Hotel in the following cases.<\/p>\n

    \u00a0<\/p>\n

      \n
    • When the application for accommodation does not conform to these Terms and Conditions<\/li>\n
    • When there are no rooms available due to full occupancy (capacity)<\/li>\n
    • When the person intending to stay is deemed likely to commit, in connection with the stay, an act that violates laws and regulations, public order, or good morals<\/li>\n
    • When the person intending to stay is deemed to fall under any of (a) through (e) below<\/li>\n<\/ul>\n

      a) When the person is a designated organized crime group, etc. under Article 2, item 2 of the \u300cAct on Prevention of Unjust Acts by Organized Crime Group Members\u300d (Act No. 77 of 1991), a person related thereto, or any other anti-social force (hereinafter referred to as \u300corganized crime group\u300d)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

      b) When the person is a corporation or other organization whose business activities are controlled by an organized crime group or its members, or a member thereof\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

      c) When the person is a corporation in which a person falling under an organized crime group, etc. serves as an officer, or a member thereof<\/p>\n

      d) When the person has been subject to a wanted notice, arrest, apprehension, prosecution, or guilty judgment for a criminal offense<\/p>\n

      e) When there has been assault, bodily injury, coercion, intimidation, extortion, fraud, or any similar act\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

      \u00a0<\/p>\n

        \n
      • When the person intending to stay has engaged in conduct causing significant nuisance to other guests, such as through intoxication, or when the Hotel deems there to be a risk thereof<\/li>\n
      • When the person intending to stay is clearly recognized as having a contagious disease<\/li>\n
      • When, in connection with the stay, a violent demand is made or a burden exceeding a reasonable scope is demanded<\/li>\n
      • When accommodation cannot be provided due to natural disaster, malfunction of facilities, or other unavoidable causes.<\/li>\n
      • When the case falls under the provisions of Article 5 of the Shizuoka Prefecture Hotel Business Act Enforcement Ordinance and the Shizuoka Prefecture Nuisance Prevention Ordinance.<\/li>\n
      • When the person who applied for accommodation made the application while concealing an intention to seek personal profit, such as by reselling the reserved room or brokering it for a fee<\/li>\n<\/ul>\n

        \u00a0<\/p>\n

        6. The Guest’s Right to Cancel the Contract<\/p>\n

        The guest may cancel the accommodation contract by so notifying the Hotel.<\/p>\n

        Where the guest cancels all or part of the accommodation contract due to causes attributable to the guest (excluding cases where the Hotel has requested payment of the application deposit pursuant to the provisions of Article 3 and the guest cancels the accommodation contract before such payment),<\/p>\n

        the Hotel shall charge a cancellation fee as set forth in Appended Table 2. In addition, where a cancellation fee other than that in Appended Table 2 was defined at the time of the accommodation contract, the cancellation fee shall be charged based on the conditions at the time of the accommodation contract.<\/p>\n

        However, in cases where the Hotel has agreed to the special arrangement under Article 4, this applies only where the Hotel, in agreeing to such arrangement, has notified the guest of the obligation to pay a cancellation fee upon cancellation of the accommodation contract.<\/p>\n

        If the guest fails to arrive by 20:00 on the day of the stay without notice (or, where an arrival time after 20:00 has been notified to the Hotel in advance, by two hours past the notified arrival time), the Hotel may treat the accommodation contract as having been cancelled by the guest.<\/p>\n

        \u00a0<\/p>\n

        7. The Hotel’s Right to Cancel the Contract<\/p>\n

          \n
        1. The Hotel may cancel the accommodation contract and the contract for use of the various facilities within the Hotel in the following cases. \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\n
            \n
          • When the guest fails to comply with the Hotel’s accommodation terms and the Hotel’s rules of use<\/li>\n
          • When the guest is deemed likely to commit, or is deemed to have committed, in connection with the stay, an act that violates laws and regulations, public order, or good morals<\/li>\n
          • When the Hotel judges the guest to be unsuitable for accommodation, such as due to a lack of proper conduct<\/li>\n
          • When the guest fails to pay, or delays payment of, the usage charges to the Hotel<\/li>\n
          • When the guest made a false application at the time of concluding the accommodation contract<\/li>\n
          • When the guest has a criminal record or history from a criminal offense and is deemed unsuitable by the Hotel<\/li>\n
          • When the guest has been subject to a wanted notice, arrest, apprehension, prosecution, or guilty judgment by a public authority<\/li>\n
          • When the guest is deemed to fall under any of (a) through (f) below<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n

            a) An organized crime group, a member of an organized crime group, an associate member of an organized crime group, a person related to an organized crime group, or any other anti-social force\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

            b) When the guest is a corporation or other organization whose business activities are controlled by an organized crime group or its members, or a member thereof\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

            c) When the person is a corporation in which a person falling under an organized crime group, etc. serves as an officer, or a member thereof<\/p>\n

            d) When the guest is a person equivalent to those in the preceding item, an organization or entity that the Hotel deems to be of the kind in the preceding items, or an organization that uses fraudulent means or intimidation, or is otherwise involved with such organizations<\/p>\n

            e) When the guest has committed assault, bodily injury, coercion, intimidation, extortion, fraud, or any similar act<\/p>\n

            f) When there is any other cause equivalent to items \u2463 through \u2467 above<\/p>\n

            \u00a0<\/p>\n

              \n
            • When the guest is clearly recognized as a person with a contagious disease<\/li>\n
            • When the guest is deemed likely to cause nuisance to other guests, such as through intoxication, or has engaged in conduct causing significant nuisance to other guests<\/li>\n
            • When, in connection with the stay, a violent demand is made or a burden exceeding a reasonable scope is demanded<\/li>\n
            • When accommodation cannot be provided due to causes arising from force majeure such as natural disaster or incident, or from malfunction of facilities, etc.<\/li>\n
            • When the case falls under the provisions of Article 5 of the Shizuoka Prefecture Hotel Business Act Enforcement Ordinance and the Shizuoka Prefecture Nuisance Prevention Ordinance<\/li>\n
            • When the guest does not comply with prohibited matters in the Hotel’s rules of use (limited to those necessary for fire prevention), such as smoking in bed or tampering with firefighting equipment, etc.<\/li>\n<\/ul>\n

              \u00a0<\/p>\n

              When the Hotel cancels the accommodation contract pursuant to the provisions of the preceding paragraph, the Hotel shall not charge for accommodation services, etc. not yet provided to the guest.<\/p>\n

              \u00a0<\/p>\n

              8. Registration for Accommodation<\/p>\n

              On the day of the stay, the guest shall register the following matters at the Hotel’s front desk.<\/p>\n

                \n
              • The guest’s name, age, gender, occupation, address, and contact telephone number<\/li>\n
              • For guests who do not have an address in Japan: nationality, passport number, place of entry, and date of entry<\/li>\n
              • Date of departure and estimated time of departure<\/li>\n
              • Other matters deemed necessary by the Hotel<\/li>\n<\/ul>\n

                When the guest intends to pay the charges under Article 12 by traveler’s checks, accommodation vouchers, credit cards, or other means that can substitute for currency, the guest shall present them in advance at the time of registration in the preceding paragraph. In addition, payment may be requested in advance at check-in.<\/p>\n

                For confirmation of items \u2460 through \u2463 above, the Hotel may request the presentation of a driver’s license, My Number card, residence card, passport, or the like. In addition, where instructed by government agencies or administrative authorities, the Hotel will make copies of personal identification documents and retain them at the Hotel.<\/p>\n

                \u00a0<\/p>\n

                9. Room Occupancy Hours<\/p>\n

                The hours during which a guest may use a guest room of the Hotel are as follows. However, in the case of consecutive nights, the room may be used throughout the day, except on the day of arrival and the day of departure.<\/p>\n

                Arrival day\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 from 15:00<\/p>\n

                Departure day\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 until 11:00 the following day(excluding dog-friendly rooms)<\/p>\n

                \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Dog-friendly rooms\u3000until 10:00 the following day<\/p>\n

                \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0\u00a0<\/p>\n

                Notwithstanding the provisions of the preceding paragraph, the Hotel may permit use of a room outside the hours stipulated therein. In such a case, the following additional charges will be applied.<\/p>\n

                Arrival day\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 14:00\u201315:00\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 3,000 yen (excl. tax)<\/p>\n

                Departure day\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 11:00\u2013noon\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 3,000 yen (excl. tax)<\/p>\n

                (Late check-out is not available for dog-friendly rooms)<\/p>\n

                \u00a0<\/p>\n

                10. Observance of the Rules of Use<\/p>\n

                While within the Hotel, guests shall comply with the rules of use established by the Hotel and posted within the Hotel.<\/p>\n

                \u00a0<\/p>\n

                11. Business Hours<\/p>\n

                The business hours of the Hotel’s facilities, etc. are provided in postings at each location, in brochures, in the in-room information, and the like. In addition, they may be temporarily changed when unavoidably necessary. In such a case, notice will be given by appropriate means.<\/p>\n

                \u00a0<\/p>\n

                12. Payment of Charges<\/p>\n

                The breakdown of the charges payable by the guest is as set forth in Appended Table 1.<\/p>\n

                Payment of accommodation charges, etc. shall be made in currency or by means that can substitute for it, such as traveler’s checks, accommodation vouchers, or credit cards approved by the Hotel, at the reception or in the guest room upon the guest’s departure or when requested by the Hotel.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

                Even where the Hotel has provided a room to the guest and it has become available for use, the accommodation charge shall be charged even if the guest voluntarily does not stay.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

                \u00a0<\/p>\n

                13. The Hotel’s Liability\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

                If the Hotel causes damage to a guest, intentionally or negligently, in performing the accommodation contract or contracts related thereto, the Hotel shall compensate for such damage. However, this shall not apply where the damage is not due to a cause attributable to the Hotel. The Hotel maintains hotel liability insurance.<\/p>\n

                \u00a0<\/p>\n

                14. Handling When the Contracted Room Cannot Be Provided<\/p>\n

                When the Hotel is unable to provide the contracted room to the guest, it shall, with the guest’s consent, arrange other accommodation facilities under conditions as similar as possible.<\/p>\n

                Notwithstanding the provisions of the preceding paragraph, when the Hotel is unable to arrange other accommodation facilities, it shall pay the guest a compensation fee equivalent to the cancellation charge, and such compensation fee shall be applied to the amount of damages. However, where there is no cause attributable to the Hotel for the inability to provide the room, no compensation fee shall be paid.<\/p>\n

                \u00a0<\/p>\n

                15. Handling of Deposited Articles, etc.<\/p>\n

                  \n
                • If loss, damage, or other harm arises with respect to articles, cash, or valuables deposited by a guest at the reception, the Hotel shall compensate for such harm, except where it is caused by force majeure. However, with respect to cash and valuables, where the Hotel has requested a declaration of their kind and value and the guest has failed to make it, the Hotel shall compensate for such harm up to a limit of 100,000 yen.<\/li>\n
                • If loss, damage, or other harm arises, through the Hotel’s intent or negligence, with respect to articles, cash, or valuables brought into the Hotel by a guest but not deposited at the reception, the Hotel shall compensate for such harm. However, for items whose kind and value were not declared in advance by the guest, the Hotel shall compensate for such harm up to a limit of 30,000 yen, except where the Hotel has acted with intent or gross negligence.<\/li>\n<\/ul>\n

                  \u00a0<\/p>\n

                  16. Custody of the Guest’s Baggage or Belongings<\/p>\n

                    \n
                  • When a guest’s baggage arrives at the Hotel prior to the stay, the Hotel shall take responsible custody of it only where it has consented before its arrival, and shall hand it over at the reception or in the guest room when the guest checks in or after check-in.<\/li>\n
                  • If, after a guest checks out, the guest’s baggage or belongings are left behind at the Hotel, the Hotel shall follow the instructions of the owner concerned. However, where there are no instructions from the owner or the owner cannot be identified, the Hotel shall keep the items for seven days, including the day of discovery, and thereafter report them to the nearest police station and follow the instructions of the police. Furthermore, food and drink, cigarettes, magazines, consumables for daily use, and similar items shall be disposed of on the same day.<\/li>\n<\/ul>\n

                    The Hotel’s liability for the custody of a guest’s baggage or belongings shall, in the case of \u2460, be as provided in \u2460 of the preceding article; in the case of \u2461, the Hotel bears no liability.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n

                    \u00a0<\/p>\n

                    17. Liability for Parking<\/p>\n

                    When a guest uses the Hotel’s parking lot, the Hotel merely lends the space, regardless of whether the vehicle key is deposited, and does not assume responsibility for the management of the vehicle. However, where the Hotel causes damage through its intent or negligence in managing the parking lot, it shall be liable to compensate for it. In using the parking lot, please follow the signs, signage, instructions of Hotel staff, and the like. Furthermore, while parked, the engine and audio shall be turned off except when necessary. The Hotel’s affiliated parking lots shall also be treated in accordance with the above.<\/p>\n

                    18. The Guest’s Liability<\/p>\n

                    If the Hotel suffers damage due to the intent or negligence of a guest, that guest shall compensate the Hotel for such damage.<\/p>\n

                    19. Regulations on Condolence Payments to Guests<\/p>\n

                    In the event that a guest of the Hotel dies during a stay at the Hotel due to a cause other than injury, the Hotel shall implement the matters set forth in the hotel liability insurance to which it subscribes and in the regulations.<\/p>\n

                    20. Governing Law and Agreed Jurisdiction<\/p>\n

                    Disputes concerning the accommodation contract between the Hotel and the guest shall be governed by Japanese law, and the district court or summary court having jurisdiction over the location of the head office of the company that manages or operates the Hotel shall be the court of exclusive jurisdiction.<\/p>\n

                    Article 21 Disclaimer<\/p>\n

                    Use of computer communications from within the Hotel shall be at the guest’s own risk. The Company shall bear no liability whatsoever even where, during use of computer communications, the service is interrupted due to system failure, radio interference, power outage, or any other reason, and the user consequently suffers any damage. Furthermore, where damage arises to the Company or a third party due to conduct that the Company deems inappropriate in the use of computer communications, such damage shall be compensated.<\/p>\n

                    At Il Azzurri, pursuant to Article 10 of the Accommodation Terms, we have established the following Rules of Use for the purpose of maintaining the dignity of the hotel and ensuring that guests spend their stay comfortably and safely; we ask for everyone’s cooperation. Should you be unable to cooperate with these rules, we may, pursuant to Article 7, paragraph 1 of the Accommodation Terms, decline the use of your room and the other facilities within the hotel. Furthermore, please note that we cannot assume responsibility for accidents arising as a result of the failure to obtain your cooperation.<\/p>\n

                    Within the Hotel, please refrain from the following acts that cause nuisance to other guests.<\/p>\n

                    * Meeting visitors in the guest room. Please meet visitors in the lobby.<\/p>\n

                    * Smoking anywhere other than designated areas.<\/p>\n

                    * Acts that may cause a fire.<\/p>\n

                    * Using guest rooms or the lobby for purposes other than accommodation, such as as a party venue, office, or business premises<\/p>\n

                    * Distributing advertisements or promotional materials, selling goods, or soliciting.<\/p>\n

                    * Going outside the guest room wearing only a bathrobe, underwear, or the like.<\/p>\n

                    * Gambling or other acts that disturb public morals or cause nuisance to others.<\/p>\n

                    * Acts that give other guests a feeling of disgust or discomfort, or nuisance acts such as noise.<\/p>\n

                    * Taking photographs for commercial purposes within the Hotel without the Hotel’s permission, or using photographs taken within the Hotel for commercial purposes.<\/p>\n

                    \u00a0<\/p>\n

                    Please use the in-room safe for the safekeeping of cash and valuables during your stay.<\/p>\n

                    In the unlikely event of loss, theft, or the like, the hotel shall bear no liability whatsoever.<\/p>\n

                    Please deposit your room key at the reception when leaving the Hotel. Furthermore, please be sure to return it at check-out.<\/p>\n

                    Requests regarding the facilities and articles within the hotel<\/p>\n

                    Please do not use them for any purpose other than their intended purpose.<\/p>\n

                    Please do not move the in-room fixtures, or alter or modify the guest room, without the Hotel’s permission. Please do not take in-room fixtures outside the guest room.<\/p>\n

                    Please do not move them to other locations or alter them.<\/p>\n

                    For the soiling, damage, or loss of facilities and fixtures inside or outside the hotel, the actual cost will be charged.<\/p>\n

                    Within the hotel, please do not use open flames for heating or cooking without the Hotel’s permission. Cooking within guest rooms is strictly prohibited.<\/p>\n

                    Please do not place items on the terrace that would spoil the appearance of the Hotel. Also, please do not drop any items.<\/p>\n

                    Please do not leave your belongings in places other than the guest room.<\/p>\n

                    During your stay, please make payment each time the Hotel presents a bill.<\/p>\n
